You are entering into a contract with Edufamtours.com, subsidiary of Educouturier Educational Advising & Management (trading as “Educouturier”).

Educouturier is an educational advising company focusing on unique educational programs and distinct study destinations.  It offers a worldwide reach, serving clients from around the world.

Edufamtours.com is a provider of educational familiarization tours to variety of educational institutions that include boarding schools, colleges, universities and other educational institutions with special program and activities focus.

  1. General Website Conditions

1.1  Agreement Between You and Edufamtours.com

 We appreciate visiting our website, (the ‘Website’). Please read carefully these terms and conditions before you start using the Website. By accessing and using this Website, you indicate that you accept (unconditionally and irrevocably) these terms and conditions (the ‘Agreement’). If you do not agree to these terms and conditions, please refrain from using our Website and exit immediately.

You represent and warrant that you possess the legal right and ability to enter into this Agreement and to use this Website in accordance with all terms and conditions herein.

 1.9  Documentation Delivery

Your documentation will be sent to the billing address of the payment method that was used to make the booking unless stated otherwise.

1.10 Use of Credit and Debit Cards

We accept Pay Pal, Visa, MasterCard and American Express credit cards. Payments are processed through PayPal with all security features provided with the service.  Your card will be debited when you click on the confirm button. The invoice and documentation will be sent to the registered billing address of the card holder.

1.11 Security

We will take all reasonable measures to insure information you transmit to us using the Website will remain confidential and protected from unauthorized access. Despite those measures, we do not warrant unauthorized access to that information can never happen. We will not be liable for any such unauthorized access unless caused solely by our gross negligence, in which event you will be entitled to compensation up to a maximum of the value of the services purchased by you.

  1. Booking Conditions

2.1 Website Accuracy

 We will try to ensure that the information on our website is accurate and up to date. However, when booking your fam tour online please read the important associated information carefully to ensure you are aware of any changes to the facilities and services on offer.

2.2 Our Pricing

 All prices on our website are intended as a guide only and are subject to change. You will be fully advised of your customized options and pricing at time of booking. Unless otherwise noted, prices are in Euro (€), per person.

2.3 Standard Familiarization Visits

When booking a standard familiarization tour, we will work directly with you and/or your representative to make all necessary arrangements.  We will be responsible for making all arrangements for the visits from the point of origin of the fam tour to the point of destination.  Travel arrangements to the point of origin (first accommodation in the itinerary of a fam tour) and from the point of departure (last location of the fam tour) should be arranged through local representative or personal arranger.  If necessary, we may assist in these arrangements on request.

2.4 Personalized Visits

When booking personalized visits we will assist you with booking your hotel and local transportation.  If requested, we may also arrange for exclusive transportation to the point of origin of the fam tour.  We may also assist you with making other arrangements with our local representatives on your request.

2.5 Bookings through third-party

We recommend that travel arrangements to and from the point of departure of each fam tour be booked with Edufamtours’ partner travel agencies.  We may provide you with a contact in the location near your place of residence.  You may also make the arrangements through your personal travel arranger or by your own.

All third-party bookings should follow all the terms and conditions of the contract and ensure that deadlines and term payments are respected.

Third parties making travel arrangements, should consider the all the other details of the Edufamtour in order to ensure that client arrives at the determined destination prior to the start of the Edufamtour.

2.6 Early Check-in and Late Check-out

Flight times may result in you arriving early to or departing late from your hotel. If this is the case we strongly advise you to either book your accommodation room the night before so that you can be assured it is ready on your arrival, or to extend your hotel booking for the night of your departure so you have full use of its facilities until you leave the hotel. You should take this into consideration when making your travel arrangements.

2.7 Passports & Visas

You must ensure that you have a valid passport in good condition and any necessary visas before travelling. Most destinations require that your passport remains valid for at least six months after your return date. It is also sensible to make a copy of all important travel documents to take with you. Please check with the desired destination country’s embassy for details on obtaining a visa, and recheck requirements for all destinations before travelling in case of any new regulations.

You may make travel arrangements and apply for visas through our recommended representatives or on your own/your designated parties.

It is your obligation to provide us with your arrival information and your hotel address, if you will be staying in another accommodation other than the one confirmed by us.

2.8 Health related matters

Travel health advice does change, and it is recommended that you contact your doctor at least six weeks prior to traveling regarding any overseas health requirements or vaccinations that you may need.

2.9 Special Requests

We will do everything we can to ensure that special requests are met, but cannot make any guarantees for requests like adjacent rooms, specific room numbers or bed types. Although they will be noted on your booking, any failure to meet special requests will not entitle you to compensation.

2.10 Your Booking Contract

When you make your booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. A contract will exist as soon as we issue our invoice. This contract is made on the terms of these booking conditions, which are governed by Canadian Law and the jurisdiction of the Canadian Courts.

If you had not seen these terms and conditions when you made your booking and you are not happy to proceed with the booking now that you have seen them please you may cancel within 48 hours of receiving your invoice. Please return all documentation to us or to your travel arranger within 7 days. Your booking will be cancelled and your monies will be returned in full, provided you have not commenced your travel. This clause does not apply if your booking was made within eight weeks of travel.

2.11 Your Educational Familiarization Tour Price

We reserve the right to alter the prices of any of the educational fam tours shown on our website and in any other literature. You will be advised of the current price of the fam tour that you wish to book before your contract is confirmed. When you make your booking, specific deposit and payment conditions apply. Our minimum requirement will be a specified deposit depending of the selected fam tour.  The balance of the price of your travel arrangements must be paid at least eight weeks before your departure date. However certain fam tours may require full payment on confirmation of the booking and may have limited rights of cancellation. Personalized visit bookings must be paid in full at least three months prior to departure. We will always advise you of the terms that apply to your reservation before confirming the booking.  If you are unable to pay your final balance by the due date, you should contact us immediately, otherwise your fam tour may be cancelled without further notice and we shall retain your deposit. All monies paid to your travel agent are held by the agent on our behalf at all times. Payments can be made by cash, cheque, debit or credit card. Visa & Mastercard payments incur a 2% surcharge and American Express incur a 2.5% surcharge. Once you have received your invoice the price of your travel arrangements is fully guaranteed and you will not be subject to any surcharges unless you will make changes to the required services.

2.12 If You Change Your Booking

If after our invoice has been issued, you wish to change your travel arrangements in any way, for example your chosen departure date or accommodation, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be made in writing from the person who made the booking or travel arranger on your behalf and must be received at our offices at least eight weeks before your departure date. This must be accompanied by a payment of €50 per person listed on the booking to cover our administration costs. You will also be required to cover any increase to the cost of your fam tour as a result of your amendment. Please note that certain travel arrangements (e.g. restricted / special airfares) may not be changeable after a reservation has been made and any alteration request could incur a cancellation charge of up to 100% of that part of the arrangements. If you wish to change your travel arrangements within eight weeks of departure this will be treated as a cancellation of the original booking and you will have to pay the applicable cancellation charges set out in clause 2.16.

2.13 If You Cancel Your Fam Tour visit

You or any member of your party may cancel your travel arrangements at any time. Written notification from the lead passenger or your travel agent must be received at our offices. Since we incur administration costs in cancelling your travel arrangements you will be required to pay the applicable cancellation charges up to the maximum shown in clause 2.16.  If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges from your insurer.

2.14 If We Change Or Cancel Your Fam Tour

It is unlikely that we will need to make any changes to your travel arrangements but we do plan the arrangements many months in advance. Occasionally changes may be made and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you or your travel agent at the earliest possible date. We reserve the right in any circumstances to cancel your travel arrangements, e.g. if the minimum number of clients required for a particular travel arrangement is not reached. However, we will not cancel your travel arrangements less than four weeks before your departure date except for reasons of force majeure or failure by you to pay the final balance. If we are unable to provide the booked travel arrangements, you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of a comparable standard from us if available (we will refund any price difference if the alternative is of a lower value). If it is necessary to cancel your travel arrangements, we will pay to you compensation as set out in this clause.

If we make a major change to your tour, we will inform you or your travel agent as soon as reasonably possible if there is time before your departure. When a major change occurs, such as the alteration of your outbound/return flights by more than 12 hours, a change of resort or a reduction in the standard of your accommodation, you will have the choice of either accepting the change of arrangements, accepting an offer of alternative travel arrangements of comparable standard from us if available (we will refund any price difference if the alternative is of a lower value) or cancelling your travel arrangements and receiving a full refund of all monies paid. In all cases, except where the change arises due to reasons of force majeure we will pay compensation as detailed below.

Due to the policies set by our transportation and hotel partners, bookings for travel during peak periods may be subject to alternative cancellation charges and the above will not be applicable. These charges will be explained at time of booking.

The compensation that we offer does not exclude you from claiming more if you are entitled to do so. Force Majeure: This means that compensation will not be payable if we are forced to cancel or change your travel arrangements in any way because of unusual or unforeseeable circumstances beyond our control. They can include, for example, war, threat of war, riot, civil strife, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, adverse weather conditions. Planning and operation of our edufamtours is guided by the latest advice from the major Foreign Ministries of different Foreign and Commonwealth Office. 2.15 If You Have A Complaint

If you have a problem during your fam tour please inform the relevant party responsible, (e.g. your booking travel agent, Edufamtours staff) and our local representative/agent immediately who will endeavour to put things right. If your complaint cannot be completely resolved locally please follow this up within 28 days of your return home by writing to our Customer Attention Department by email complaint@edufamtours.com giving your booking reference and all other relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you. It is strongly recommended that you communicate any complaint to the supplier of the services in question as well as to our local representative/agent without delay and complete any available report form whilst in resort. If you fail to follow this simple procedure we will have been deprived of the opportunity to investigate and rectify your complaint whilst you were in resort and this may affect your rights under this contract.

2.16 Our Liability To You

For flight, ground transportation and accommodation bookings we act as an agent for the service providers and cannot accept responsibility for any injury, illness or death however caused, except where caused by our own proven negligence. Whilst we will offer such assistance as we can in respect of any dissatisfaction with the standards of services, we do not accept any further liability. For personalized EduFamTour visits, if the contract services we have with you is not performed or is improperly performed by us or our suppliers we will review the matter immediately. However, we will not be liable where any failure in the performance of the contract is due to: you; or a third party unconnected with the provision of the travel arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we or our suppliers, even with all due care, could not foresee or forestall. Our liability, except in cases involving death, injury or illness, shall be limited to a maximum of two times the cost of your travel arrangements based on standard educational fam tour. Our liability will also be limited in accordance with and/or in an identical manner to (a) The contractual terms of the companies that provide the transportation for your travel arrangements. These terms are incorporated into this contract; and (b) Any relevant international convention, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, which limit the amount of compensation that you can claim for death, injury, delay to passengers and loss, damage and delay to luggage. We are to be regarded as having all benefit of any limitation of compensation contained in these or any conventions. You have rights in some circumstances to refunds and/or compensation from your airline in cases of denied boarding, cancellation or delay to flights. Full details of these rights will be publicised at EU airports and will also be available from airlines. However reimbursement in such cases is the responsibility of the airline and will not automatically entitle you to a refund of your fam tour cost from us. Your right to a refund and/or compensation from us is set out in clause 2.16. If any payments to you are due from us, any payment made to you by the airline will be deducted from this amount.

2.17 Personal injury unconnected with your booked travel arrangements

If you or any member of your party suffer death, illness or injury whilst overseas arising out of an activity which does not form part of your package arrangements or an excursion arranged through us we shall at our discretion offer advice, guidance and assistance to help you in resolving any claim you may have against a third party, provided we are advised of the incident within 90 days of its occurrence. Where legal action is contemplated our written consent must be obtained prior to commencement of proceedings and our consent is subject to your undertaking to assign any cost received or any benefits received under any relevant insurance policy to ourselves.

2.18 Passport, Visa and Immigration Requirements

Your specific passport, visa and other immigration requirements are your responsibility and you should confirm these with the relevant Embassies and/or Consulates. We do not accept any responsibility if you cannot travel because you have not complied with any passport, visa or immigration requirements.  We can provide you with a list of our partner agencies that can assist you in visa arrangements.

2.19 Excursions & other visits

Within your familiarization tour, we will provide other activities. Some of them may be already included in the price of the fam tour while others may require additional fees.  Some of those excursions or other tours that may be part of your fam tour visit or which you choose to book or pay for during the fam tour are not part of your package provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.

2.20 Travel & Medical Insurance

We strongly recommend that prior to travelling, all clients obtain a fully comprehensive policy of travel and medical insurance suitable for your specific requirements. In our packages, we include additional travel insurance for the duration of the fam tour with flight and other related insurance which however may not have sufficient coverage as per your personal request.  Therefore, we encourage you to purchase additional insurance.

2.21 Data protection policy

In order to process your booking and to ensure that your travel arrangements run smoothly and meet your requirements, we need to use the information which you provide such as name, address, and any special needs/dietary requirements etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass your information on to the relevant suppliers of your travel arrangements such as airlines, hotels, transport companies etc. This information may also be provided to security or credit checking companies, public authorities such as customs/ immigration if required by them, or as required by law. Additionally, where your fam tour is outside the European Economic Area (EEA), controls on data protection in your destination may not be as strong as the legal requirements in the EU. However, we will not pass any information onto any person not responsible for part of your fam tour and travel arrangements. This applies to any sensitive information that you give to us such as details of any disabilities, or dietary/religious requirements. (If we cannot pass this information to the relevant suppliers, whether in the EEA or not, we cannot provide your booking. In making this booking, you consent to this information being passed on to the relevant persons). Please note that where information is also held by your travel agent, this is subject to your agent’s own data protection policy. Your data controller is: Managing Director, Edufamtours.com. You are entitled to a copy of your information held by us. If you would like to see this, please contact the data controller. We will make a small charge of €30 to cover the cost of extracting this archived data.

2.22 Marketing

We will hold your information, where collected by us, and may use it to inform you of offers in the future or to send you brochures. If you do not wish to receive such information in the future please send your name and address details to unsubscribe@edufamtours.com
